§ 4.4. Mayor's Powers and Duties.

  • The Mayor shall be the chief executive and chief administrator of the City. He shall have the following powers and duties:
    1. 
    He shall preside at meetings of the Council, but he shall have the right to vote only in case of a tie. He may call special meetings of the Council as provided in Section 3.10(A).
    2. 
    He shall at the beginning of each fiscal year and may at any other time give the Council information as to the affairs of the City and any recommendations he may have.
    3. 
    An ordinance or resolution adopted by the Council shall be presented to the Mayor for his approval. The Mayor shall either sign the same, or within seven (7) days after receipt of the ordinance or resolution, return it with a written statement of his reasons for disapproval. Ordinances or resolutions vetoed by the Mayor shall be considered at the next regular meeting of the Council, and the Council may pass the ordinance over the veto by an affirmative vote of two-thirds (2/3) of its members. The effective date of an ordinance passed over the Mayor's veto shall be the date of final passage, unless otherwise specified by the Council.
    4. 
    He shall see that all laws, provisions of the Charter and acts of the Council, subject to enforcement by him or by officers subject to his direction and supervision, are faithfully executed.
    5. 
    He shall appoint, with the advice and consent of the City Council and, when he deems it necessary for the good of the service, suspend or removal all City employees and appointive administrative officers provided for by or under this Charter, except as otherwise provided by law, by this Charter or by personnel rules adopted pursuant to this Charter. He may authorize any administrative officer who is subject to his direction and supervision to exercise these powers with respect to that officer's subordinates.
    6. 
    He shall direct and supervise the administration of all departments, offices and agencies of the City, except as otherwise provided by this Charter or by law.
    7. 
    He shall prepare and submit the annual budget and capital program to the Council.
    8. 
    He shall exercise such other powers and perform such other duties as may be prescribed by this Charter, by ordinance or by law.
