§ 400.150. Use Regulations.

  • A. 
    In the "C-1" District no building or land shall be used and no building shall be erected or structurally altered except for one (1) or more of the following uses:
    1. 
    Any use permitted in the "R-1" District.
    2. 
    Any use permitted in the "R-3" District.
    3. 
    Any use permitted in the "S-1" District.
    4. 
    Business or commercial buildings.
    5. 
    Business or commercial uses.
    6. 
    Public or private clubs or organizations.
    7. 
    Any apartment dwelling above the ground floor of a commercial or business building.
    8. 
    Public or private information signs.
    9. 
    Hospitals.
    10. 
    Nursing Homes.
    11. 
    Libraries.
    12. 
    City or government offices and buildings.
    13. 
    Any accessory buildings or uses.
    B. 
    A ground floor apartment unit or residential unit may be permitted in the "C-1" District, subject to the following conditions:

    1. 
    Such ground floor apartment unit or residential unit shall be located to the rear or away from the front of a street level commercial building.
    2. 
    Ground floor space facing onto Main Street shall not be used for an apartment unit or a residential unit purpose.
    3. 
    Entrance to the ground floor apartment unit or residential unit may be located on Main Street or a side street.
    4. 
    Commercial buildings with a ground floor apartment unit or residential unit shall have not less than five hundred (500) square feet exclusively reserved for commercial activity located in the front of the building or facing the front of the building.
    5. 
    Any property located within the "C-1" Commercial District not in compliance with this Subsection (B) on the date of August 24, 2017, shall be exempt from the provisions of Subsection (B) as a non-conforming use until such time as the non-conforming use of the property shall have been discontinued for a period of sixty (60) days or more.
